Q Am I subject to penal sanctions if I employ foreign residents who are not authorized to work in Japan?

就労が認められない外国人を雇用すると罰則がありますか。
A Article 73 of the Immigration Control Act defines foreign residents who engage in any remunerative activities when unauthorized or who have stayed beyond the approved period as illegal workers. The Immigration Control Bureau provides penal sanctions those who violate its provisions. Those who encourage illegal working activities of foreign residents may be punished with imprisonment not exceeding three years and/or with fines not exceeding 2,000,000 yen.

就労が認められない在留資格の外国人や在留期間を超えて残留している外国人が行う就労活動は、入管法第73条で「不法就労活動」と定義され、外国人の不法就労活動を助長した人は、3年以下の懲役又は200万円以下の罰金に処せられます。

[ Article 73 of the Immigration Control Act
入管法第73条

Except for cases to which the provisions of Article 70, Paragraph 1, Item (4) of the Immigration Control Act are to be applied, any person who has been engaged in activities involving the management of a business involving income or other activities for which he receives remuneration in violation of the provisions of Article 19, Paragraph 1, shall be punished with penal servitude or imprisonment of not more than 1 year or a fine not exceeding 200,000 yen, or shall be punished with either penal servitude or imprisonment and a fine.

第70条第1項4号に該当する場合を除き、第19条1項の規定に違反して収入を伴う事業を運営する活動又は報酬を受ける活動を行なった者は、1年以下の懲役若しくは禁錮20万円以下の罰金に処し、又はその懲役若しくは禁錮及び罰金を科する。
